Excavator Alleged Noncompliance Report


NOTICE: noncompliance reports must be submitted no later than 30 days after the noncompliant event was discovered.


Use this form to report excavation activity that may not be in compliance with the Underground Facility Damage Prevention and Safety Act, Chapter 556, Florida Statutes. Sunshine 811 has no statutory authority to investigate reported incidents of non-compliance, to mediate disputes between excavators and members, to determine if violations of Chapter 556, F.S. have occurred, or to issue citations for violations of Chapter 556, F.S. The excavator named below will receive a letter, Damage Prevention Guide and the offer of additional education. Sunshine 811 will also use the information to develop educational programs.

Note: If this alleged noncompliance report is due to a damage, please report to Florida DIRT. Effective July 1, 2017, Sunshine 811 members are required to report excavation damage to pipes, cables, protective coverings and other underground facilities per s.556.105(12)(b)
