Noncompliance Program

Sunshine 811’s Noncompliance Program is a way to educate members and excavators who allegedly did not properly follow the provisions in Chapter 556, F.S. It also promotes open communication between excavators and member operators.

When should I submit a noncompliance form?

Noncompliance forms should be submitted no more than 15 calendar days after the alleged noncompliant action. Reports are generally processed within two weeks. If you have an issue that needs immediate resolution, please contact the member listed on your locate ticket or excavator to resolve the matter.

How do I submit a report?

Complete either the member or excavator noncompliance forms, indicating the alleged noncompliance instances. When you’ve finished gathering the information and entering it into the online form, simply submit and the website will take care of the rest.

How quickly will I get a response back from Sunshine 811 regarding the status of a noncompliance report?

You will be copied on the email we send to the alleged noncompliant person. These forms are not processed in real time so there may be a waiting period of up to two weeks. Sunshine 811’s safety education liaisons offer education where appropriate, but no follow up to the original reporting party is currently conducted.

What does Sunshine 811 do with this information?

Sunshine 811 uses this information to identify patterns in the types of noncompliant actions and where they are occurring to develop new or modify existing educational programs and awareness campaigns.

Is there a fine associated with a noncompliance?

There is no fine for noncompliant events. If you are reporting an alleged violation of s.556.107, you could request your locate law enforcement agency issue a fine.
